Terms of service

Last updated: 18 October 2026

This is a courtesy translation. Only the German version is legally binding.

1. Scope

These terms of service govern the contractual relationship between you and the provider (see §2) for the use of the “patchio” application — available at app.patchio.de — and all connected services. By registering an account, you agree to these terms. They supplement the privacy policy.

2. Provider

Stefan Mende
Obere Hausbreite 9
80939 Munich
Germany
Email: kontakt@patchio.de

Full provider details in the legal notice.

3. Subject matter and scope of the service

patchio is a digital organisation tool for families and blended-family households. Among other things, the application provides the following features: calendar, task and shopping lists, meal planning, a directory for contacts, an emergency card, membership in several households and groups, data export and account deletion.

The exact scope of features follows from the version of the application currently available. We keep developing patchio; individual features may be added, changed or discontinued. We communicate significant changes in advance.

4. Formation of contract and registration

The usage agreement comes into effect once you successfully register and accept these terms of service and the privacy policy. You undertake to provide truthful information when registering, in particular to use a valid email address.

Your sign-in details must be kept confidential. You're required to choose a sufficiently secure password and protect it from access by third parties. If you suspect misuse, change your password immediately and inform the provider.

5. Requirements for use

Use of patchio is open to natural persons who have turned 16. People under 16 may only use patchio with the express consent of, and under the responsibility of, their parents or legal guardians.

Data belonging to children (e.g. birthday, emergency card) is maintained in the application by their parents or legal guardians. Children under 16 only get their own login through an invitation from a household admin with parental responsibility, who gives their consent by doing so. People under 16 aren't intended to register on their own.

6. Subscription & pricing

patchio is a paid service. There's one subscription per household, covering every member of that household — including invited babysitters. There are no extra costs billed per person.

  • €4.99 per month (incl. statutory VAT), or
  • €39 per year (incl. statutory VAT)

All prices are per household and include statutory VAT. The price that applies at the time is shown to you clearly before you complete your order.

7. Try it for free

You can try patchio free for 30 days — without providing payment details and without a credit card. You incur no costs whatsoever during the trial.

No automatic charge takes place. When the trial ends, no paid subscription is created automatically; a fee is only charged if you actively take out a paid subscription. If you don't subscribe, access to the paid features ends — there's no permanently free version. Your data is kept and becomes accessible again as soon as you take out a subscription.

8. Formation of the subscription contract

The paid subscription contract comes into effect when you select your chosen plan (monthly or yearly) during checkout, provide your payment details, and confirm the order via the button expressly marked as involving a payment obligation (“order with obligation to pay” or similar) (§312j(3) BGB). Before you complete the order, we show you a summary of the plan, the price including VAT, and the term.

Payment is processed through our payment provider, Stripe (see the privacy policy). After checkout, you'll receive a confirmation and an invoice by email.

As a consumer, you have a statutory right of withdrawal of 14 days from the formation of the contract. Details are in the withdrawal notice.

9. Term, renewal and cancellation

The subscription initially runs for one month on the monthly plan, and one year on the yearly plan. After the initial term ends, it renews for an indefinite period and can be cancelled at any time with one month's notice (§309 no. 9 BGB). There's no minimum contract term beyond the initial term.

You can end your subscription directly in the application via /kuendigen or through the customer portal — without giving a reason and without contacting us separately. If you cancel at the end of the initial term, access remains available until then; fees already paid for the initial term aren't refunded pro rata, unless a right of withdrawal applies. After the initial term, the subscription ends once the one-month notice period has passed; access remains available until then, and we refund fees paid in advance for the time after that pro rata.

10. Price changes

We may adjust subscription prices, for example because of rising costs or an expansion of the service. We'll announce a price change to you clearly, in text form (by email to your registered address), at least six weeks before it takes effect.

If you don't agree with the change, you can end your subscription using a special right of cancellation before the price change takes effect. If you don't cancel, continued use counts as acceptance of the new price; we'll point this out separately in the announcement.

Founder prices are excluded: a subscription taken out at the founder price of €4.99 per month or €39 per year keeps that price permanently. A price increase under this section doesn't apply to it.

11. Late payment

If a due payment doesn't go through (e.g. because of a failed direct debit or an expired card), we'll notify you and give you the opportunity to update your payment details.

If payment remains outstanding, we may restrict the paid features: creating and editing content is locked. Your existing data remains readable and isn't deleted; once the outstanding payment is settled, patchio is fully available to you again.

12. User obligations

You agree not to misuse patchio. In particular, it's prohibited to:

  • Use the application in a way that impairs its stability, security or integrity (e.g. automated mass requests, unauthorised stress tests, circumventing authentication).
  • Post content that's unlawful, infringes third-party rights, violates personal rights, is insulting, or incites criminal offences.
  • Enter third parties' personal data (in particular in the directory or emergency card) without their consent or without a valid legal basis. For your own children, parental responsibility serves as the legal basis.
  • Share your login details or give third parties access to your own account.
  • Decompile or reverse-engineer the application, or circumvent its protective mechanisms.

In the event of violations, we reserve the right to block, restrict or end access — for serious violations, even without prior notice. In minor cases, we'll usually issue a warning before any suspension.

13. User content and rights granted

All content you post in patchio (e.g. events, lists, contacts, recipes, emergency card information) remains your intellectual property. The provider uses this content solely to deliver the agreed features, in particular for storage, display and sharing with the recipients you designate (e.g. other household members or groups).

For this purpose, you grant the provider a simple, non-exclusive right, limited to the term of the contract, to store, process and display this content within the application. Any use beyond that (e.g. for advertising or training purposes) doesn't take place.

You're responsible for the content you post. For content that's clearly unlawful, we reserve the right to remove it once we become aware of it and to inform you accordingly.

13a. Reporting illegal content

If you believe content in patchio is illegal — for example in a list or calendar shared with you, or in a public poll — you can report it to us (Art. 16 DSA): by email to kontakt@patchio.de or via the (choose “Report illegal content”). So that we can review it, your report should include:

  • where the content is (link or exact description of the place in the app),
  • why you believe it is illegal,
  • your name and email address (not required for reports about child sexual abuse material),
  • your statement that you believe in good faith that the information is accurate and complete.

We confirm receipt, review the report promptly, carefully and objectively, and inform you of our decision. Decisions are made by a person, not by automated means.

If we restrict content or an account as a result — for example by removing, blocking or terminating it —, we give the person affected a clear and specific statement of reasons (Art. 17 DSA): what we decided, which facts and circumstances we relied on, and whether we consider it illegal or a breach of these terms.

If you disagree with our decision — as the person reporting or the person affected —, you can lodge a complaint by email to kontakt@patchio.de within six months. We will then review the case again and inform you of the outcome. You can also turn to a certified out-of-court dispute settlement body (Art. 21 DSA) or take legal action.

14. Availability and maintenance

We aim for the highest possible availability of the application, but don't guarantee uninterrupted or error-free use. We don't commit to a specific level of availability (e.g. expressed as a percentage).

Maintenance and update work may lead to temporary restrictions. We'll announce larger planned maintenance windows in the application in advance, where possible.

Note: patchio is under active development. Individual features may still change, and occasional unexpected errors can occur. We recommend keeping critical data (e.g. emergency card information) available outside the application as well, and using the data export (via your profile) regularly.

15. Liability

We're liable without limitation for damages arising from injury to life, body or health caused by an intentional or negligent breach of duty by the provider, and for other damages caused by an intentional or grossly negligent breach of duty by the provider.

For other damages caused by a slightly negligent breach of material contractual obligations (so-called cardinal obligations, whose fulfilment makes proper performance of the contract possible in the first place, and on whose observance users may regularly rely), liability is limited in amount to the foreseeable damage typical for this type of contract.

Any liability beyond that — in particular for slight negligence regarding non-material contractual obligations, for loss of profit, and for indirect and consequential damages — is excluded.

Liability under the Product Liability Act and for defects fraudulently concealed remains unaffected.

With regard to data loss, the above limitation of liability applies with the proviso that the provider is only liable for the effort that would have been required to restore the data had it been backed up regularly and appropriately. You're responsible for making your own reasonable backups of critical data (e.g. via the available data export).

16. Privacy

The processing of personal data is described in the privacy policy. It forms part of this usage relationship but doesn't replace the validity of these terms of service.

17. Ending the usage relationship

You can end your usage relationship at any time. Account deletion can be requested directly in the application via your profile. A 30-day grace period applies, during which you can withdraw the deletion request. After that, your personal data is anonymised or deleted (see the privacy policy for details).

The provider may terminate the usage relationship with four weeks' notice to the end of a calendar month. For serious breaches of these terms of service or of statutory provisions, termination without notice is possible. Before terminating without notice, the provider will, where possible, warn you and give you the opportunity to respond.

18. Changes to these terms of service

We reserve the right to adjust these terms of service where this is necessary due to changes in the law, technical requirements, or further development of the application.

Changes are shown to you in the application no later than at your next login; for significant changes we'll also inform you by email to your registered address. Your acceptance and the version accepted are stored so the legal basis stays traceable.

If you don't agree to the changed terms, you can end your usage relationship before the change takes effect. Continued use after the change takes effect counts as acceptance, to the extent this is permitted under the law applicable at the time of the change.

19. Dispute resolution

The provider isn't willing or obliged to take part in dispute resolution proceedings before a consumer arbitration board.

20. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the law of the country where the user habitually resides remain unaffected.

Where the user is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is the provider's registered seat in Munich.

Should individual provisions of these terms of service be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by a rule that comes as close as possible to the economic purpose of the invalid provision.
